As a basic approach of government and governance，the rule of law is a basic hallmark of a nation’s marching towards modern civilization Chinese socialist rule of law，or socialist rule of law with Chinese characteristics，means rule of law  rooted in Chinese soil and rule of law as conceived and guided by the Communist Party of China. As such，it is not merely a means or a tool，but is also endowed with the power of traction and the function of guiding and regulating Chinese human rights are human rights envisioned and guided by the CPC，have unique characteristics in terms of theory，path design and institutions，and fundamentally differ in nature from Western rule of law and human rights. Human Rights are the basic tenet and fundamental goal of rule of law and rule of law represents the recognition of and protection for human rights. Human rights protection should be fostered comprehensively，through legislative protection，enforcement protection and judicial protection.
